Teacher Molests Three Girls ... Only Gets 90 Days

I have long been saying that our children will rebel against us one day because we have flat out refused to protect them. Why would they take care of us when we are old and decrepit if we didn't take care of them? The biggest failure of society to protect our children is to allow sexual predators to go free with little to no punishment.

I have lost all faith in judges to adequately punish child predators. Many have said that judges refuse to punish these predators because the judges themselves are predators. Perhaps these people are right. Maybe NAMBLA membership is chalk full of judges, and they are looking out for their own. After all, that is what secret societies do.

Nevada is widely recognized as having a horrific judicial system ... especially when it comes to protecting kids. Frankly, it would take too long to explain, but you locals know what I'm talking about.

A couple of days ago Don Smith, a former music teacher at Tate Elementary, was sentenced to 90 days behind bars for touching the breasts of a little girl in his class who was under 14 years old. Now I should preface this by saying that this comes from Channel 13 News' website, and they are notorious for not giving you details.

A former Clark County school teacher will spend 90 days behind bars for touching a student's breasts.

A judge also sentenced Don Smith to up to four years probation and extensive counseling.

The sentence is part of a plea deal Smith agreed to in December.

Smith was teaching music at Tate Elementary School.

His attorney said he was just counseling the girl, but the prosecutors say he touched her inappropriately and on purpose.

Smith was warned several times over the years by the Clark County School District not to hug students.

They also have a video on their website.

You'll notice that the school district had to "warn" Smith several times over the YEARS to not touch the children. Just so you know ... the Clark County School District is one of the worst in the country. No that's not opinion ... it's a proven fact year after year.

If you have to warn a teacher to stop hugging children several times over the years, but he continues to do it, why wasn't he removed from the classroom. Clearly, if you are repeatedly told to not touch children yet you continue to do so ... you have a compulsion. It is blatantly obvious that Smith could not control his actions, but the district and school didn't act to remove him from the classroom. Therefore, I hold them responsible, and I hope the victim's family does as well.

Remember, Channel 13 doesn't give good details on their website. So I went back to the local newspaper to review the case, and found extremely disturbing information. Smith didn't accept a plea for touching one student's breasts ... it was three students he violated.

A Tate Elementary School music teacher accused of molesting three students told a judge Tuesday that he intends to accept a plea deal in District Court.

Don Kevin Smith is expected to make an Alford plea to one count of attempted lewdness with a minor under 14, which carries a potential prison sentence of two to 20 years.

An Alford plea does not involve an admission of guilt but acknowledges that prosecutors could prove their case if it went to trial.

So the plea deal he received holds a sentence of 2-20 years. Why did he get only 90 days? Even if the charge is probational as expressed by the paper ... the judge has an obligation to give a sexual predator more than 90 days for violating 3 girls.

It gets better:

According to his arrest report, Smith admitted to investigators that he touched the breasts of three students.

He originally was charged with two counts of lewdness with a minor under 14.

Prosecutor Lisa Luzaich said she agreed to drop the other charges in exchange for his plea to attempted lewdness because it keeps open the possibility of Smith receiving as much as two decades in prison and it also would ensure that Smith receives a felony on his record and never teaches again.

"If I can do all that without making three young girls testify than that's a good thing," she said.

This is when I got really pissed talking about this on my show.

The prosecutor did the right thing by guaranteeing a felony charge while not requiring the three victims to relive the assaults. The reason the prosecutor even accepted the plea is because Smith would face a tougher sentence than with the other charges. So the prosecutor positioned herself to get a guaranteed conviction with a stiffer sentence for the child predator than she may have gotten with a trial. That's good lawyering, and she should be commended with her efforts.

Unfortunately, her plan backfired on her when Justice of the Peace Tony Abbatangelo decided that the 2 year minimum for Smith's plea deal was too harsh, and only sentenced him to 90 days behind bars.

To summarize:

  • We have a teacher who admitted to molesting not one, not two, but three elementary school girls.
  • The prosecutor only accepted the plea deal because the predator would receive a felony with 2-20 years in prison.
  • The judge felt two years was too harsh for a child predator who assaulted a minimum of three young girls, and gave him a mere 90 days with probation and counseling.

Now that's justice.

Horrendous Orphanage Found In Iraq

For now this is a CBS exclusive story.

US forces discovered a pretty sickening situation at an Iraqi orphanage. I've included a couple more photos below.

It was a scene that shocked battle-hardened soldiers, captured in photographs obtained exclusively by CBS News.

On a daytime patrol in central Baghdad just over than a week ago, a U.S. military advisory team and Iraqi soldiers happened to look over a wall and found something horrific.

"They saw multiple bodies laying on the floor of the facility," Staff Sgt. Mitchell Gibson of the 82nd Airborne Division told CBS News chief foreign correspondent Lara Logan. "They thought they were all dead, so they threw a basketball (to) try and get some attention, and actually one of the kids lifted up their head, tilted it over and just looked and then went back down. And they said, 'oh, they're alive' and so they went into the building."

This is a government run orphanage for special needs children.


"I saw children that you could see literally every bone in their body that were so skinny, they had no energy to move whatsoever, no expression on their face," Staff Sgt. Michael Beale said.

"The kids were tied up, naked, covered in their own waste — feces — and there were three people that were cooking themselves food, but nothing for the kids," Lt. Stephen Duperre said.


While the soldiers saw these images of the starving children ... they found three workers cooking for themselves.

Logan asked: So there were three people cooking their own food?

"They were in the kitchen, yes ma'am," Duperre said.

With all these kids starving around them?

"Yes ma'am," Duperre said.

It didn't stop there. The soldiers found kitchen shelves packed with food and in the stockroom, rows of brand-new clothing still in their plastic wrapping.

Instead of giving it to the boys, the soldiers believe it was being sold to local markets.

The man in charge, the orphanage caretaker, had a well-kept office — a stark contrast to the terrible conditions just outside that room.

"I got extremely angry with the caretaker when I got there," Capt. Benjamin Morales said. "It took every muscle in my body to restrain myself from not going after that guy."

That caretaker is now on the run, and has disappeared. They did take two guards into custody though.

Also in an Abu Ghraib esc moment ... two of the women who worked there posed for pictures with the naked boys. They too are on the run.

Woman Who Had Sex With Minor Gets No Jail Time

She had sex with a 15 year old boy, and won't go to prison for it. The judge called it a "foolish lapse", and gave her a pass because she drank 3 bottles of vodka a week (like that's a lot). She plead guilty, and has been rehabbing.

I'm far more concerned about the charge she plead guilty to than anything else. SHE plead guilty to one count of sexual penetration of a child under the age of 16. Maybe this is the American in me, but how can a woman be charged with penetration? Unless ... OH GOD ... EEEEWWWW!

Geek Squad Technician Caught Recording Family's 13 Year Old Daughter In Shower

A woman and her mother sued Best Buy and its "Geek Squad" computer repair team Wednesday, claiming they were legally responsible for dispatching a technician who allegedly videotaped the daughter taking a shower.

The suit, filed in Los Angeles County Superior Court on behalf of Sarah Vasquez, 22, and her mother, Natalie Fornaciari, 46, both from city of Industry, alleges that Geek Squad technician Hao Kuo Chi, 26, placed his cellphone in Vasquez's bathroom during a computer service call March 4 and recorded her showering.

The story goes on to explain how the daughter found the camera.

According to the suit, Chi came to the family's home last month for a scheduled computer service appointment. After starting to work, he asked to use the bathroom and was shown to one shared by Vasquez and her 13-year-old sister, Kelly Rocha, the lawsuit said.

Vasquez later showered in the same bathroom. When she stepped out of the stall, she noticed a cellphone propped up on her cluttered sink, the suit said. The phone was covered in a leather case; a small camera with a red, blinking light was sticking out, she said.

Suspicious, Vasquez left the bathroom to tell her sister Kelly and when she returned, the phone was gone. Kelly then found the phone in her bedroom. Believing the phone was programmed to record her as well, she removed its memory chip and she and Vasquez took it to a Verizon store to see what was on it.

"You could see him on the video setting it up," Vasquez said. "I was shocked."

The sisters called their stepfather, who reported Chi to police, and he was arrested at their house.

The family is seeking compensatory and punitive damages for alleged fraud, negligent misrepresentation and hiring, invasion of privacy, intentional infliction of emotional distress and breach of warrant.

Pretty bold loser ... pretty bold.

"How To" Website For Pedophiles Is Legal

Stegl.org (Seattle-Tacoma-Everett Girl Love) is the website, but it is down at the moment. Probably trying to hide, or it has been overrun because of the coverage it has been getting from Fox News today.

"As disturbing and offensive as we find this, there's no evidence of a crime, or even suspicion of illegal activity," said Rebecca Hover of the Snohomish County Sheriff's Department.

The man who runs it, 45-year-old Jack McClellan, has never been convicted of a sex crime, which means he can attend any family-friendly events where children are present, and take all the pictures he wants for his Web site. He also lives close to a school bus stop.

McClellan says his purpose is to promote association, friendship and legal, consensual hugging and cuddling between men and pre-pubescent girls. He admitted to FOX News that his "age of attraction" is between 3 and 11 years old.

"I guess the main thing is I just think they're cute, a lot cuter than women. I admit there is kind of an erotic arousal there," McClellan said.

I've said it before, and I'll say it again: Some people do not deserve to live.

Lawmakers Trying To Ban Minors From Online Communities

The bill will include community sites like Myspace, and chat rooms. Basically, if you aren't 18 you can't interact with other people online without your parent's permission.

It's stupid ... I know. What do you expect from a bunch of adults who don't understand IT?

Ohio Won't Send You To Prison For Raping Kids, But They'll Make Damn Sure They Can See You At Night

If you don't know about Ohio's lack of action against those who harm children ... do a google. There just isn't time to cover it all here. Even though Ohio officials seem to have a real problem putting predators behind bars ... they will come up with any stupid idea to trick their constituents into believing they really do care.

(AP) - Ohio already tags repeat drunken drivers' cars with bright yellow license plates. Now it wants to make convicted sexual predators use fluorescent green ones.

A bill introduced Wednesday would require all habitual and child-oriented convicted sex offenders to display the easy-to-spot plates.

No other state has tried the tactic, according to the National Conference of State Legislatures, though some require a designation to appear on sex offenders' driver's licenses. Ohio briefly considered requiring pink plates for sex offenders but changed the color because it was associated with breast cancer survivors.

Democratic Gov. Ted Strickland, who took office in January, would sign the latest bill if it passed, press secretary Keith Dailey said.

Christine Link, executive director American Civil Liberties Union of Ohio, criticized the proposed requirement as political grandstanding. She said it could leave children with the idea that anyone without the special plates was safe to approach.

But Republican Sen. Kevin Coughlin, who introduced the latest legislation with Democratic Rep. Michael DeBose, said the plates would send parents and children an instant message to beware. Ohio already requires repeat drunken drivers to display bright yellow tags.

The bill is the latest in a series of Ohio measures to crack down on sex crimes. Among them: tougher minimum sentences for rapists of children under 13; increased penalties for public indecency involving victims under 13; and mandatory tracking devices after those classified as sexually violent predators serve their sentences.

Just so we're clear about were Ohio stands on sex offenders:

  • Prison = bad
  • Fluorescent lights = good

Yeah ... good luck with that.
